1) About Utsaah & Agreement to Terms
Welcome to Utsaah (“Utsaah”, “we”, “us”, “our”), a wellness studio offering Reformer Pilates, Yoga, and recovery/healing therapies, along with classes, workshops, events and retail. By accessing our website, booking platform, studio or services (collectively, the “Services”), you agree to be bound by these Terms & Conditions (“Terms”).
2) Eligibility & Health Responsibility
You confirm you are at least 18 years old (or accompanied by a legal guardian if younger).

You agree to consult a physician before participating and to disclose relevant medical conditions, injuries, pregnancy, recent surgeries, or other limitations before class.

You acknowledge that physical activity carries inherent risks and you participate voluntarily, assuming full responsibility for your health and safety.

3) Medical Disclaimer
Utsaah does not provide medical advice. Nothing in our Services replaces consultation, diagnosis or treatment from a licensed medical professional. If you experience pain, dizziness, or discomfort, stop immediately and inform your instructor.
4) Bookings, Attendance & Studio Access
Pre-booking is recommended for all classes and therapies; walk-ins are subject to availability.

Check-in at least 10 minutes prior to class. Entry may be denied after start time for safety and to avoid disruption.

We may substitute instructors, modify class formats, or reschedule sessions when required.

Utsaah reserves the right to refuse service for safety, capacity, or policy reasons.

5) Cancellations, No-Shows & Late Arrivals
Group Classes: Cancel at least 12 hours prior to start to avoid forfeiture/fee.

Private Sessions/Therapies: Cancel at least 24 hours prior to start.

No-shows and late cancellations result in loss of the session and/or a fee.

Late arrivals may be refused entry; if admitted, remaining time only.

6) Memberships, Class Packs & Expiry
Memberships (time-based) and class packs (session-based) are non-transferable and non-shareable.

Class packs carry expiry dates (e.g., 12-session pack valid for 30 days). Unused sessions expire; extensions are not guaranteed.

Membership start date begins on purchase or first use, as specified at checkout.

7) Freezes, Extensions & Special Circumstances
Membership freeze may be requested for medical reasons or travel over 14 days with supporting proof.

Freezes must be requested in advance and are granted at Utsaah’s discretion.

Workshops, special events and limited-series courses are not eligible for freezes unless required by law.

8) Auto-Renewal & Billing (if applicable)
Certain memberships may auto-renew. You’ll be notified at purchase; you can cancel auto-renewal before the billing date via your account or written notice (e.g., 7 days prior).

You authorize Utsaah to charge your saved payment method for recurring dues, fees and applicable taxes until you cancel.

9) Pricing, Payments & Refunds
Prices are in INR and inclusive/exclusive of taxes as stated at checkout.

We accept the payment methods shown on our platform; third-party gateway terms apply.

Except where expressly stated, all sales are final. Refunds are not provided for change of mind, schedule conflicts or unused time.

If Utsaah cancels a class/service, we will credit or reschedule your session.

Gift cards, promotions and trial offers are subject to separate terms and may carry expiry dates.

10) Workshops, Events & Courses
Event tickets are non-refundable unless Utsaah cancels the event.

Transfers (to another date/person) may be allowed with advance written request and are subject to availability and admin fees.

Some events may require waivers or specific prerequisites (e.g., experience level, medical clearance).

11) Conduct, Safety & Studio Etiquette
To keep the studio safe and respectful, you agree to:
Wear appropriate attire and grip socks where required.

Silence mobile devices and avoid filming or calls during sessions.

Use equipment as instructed; report any malfunction immediately.

Maintain personal hygiene; refrain from wearing strong fragrances.

Treat members and staff with respect; harassment or disruptive behavior will result in removal and possible ban.

Follow instructor and staff guidance at all times.

12) Personal Belongings
Bring minimal valuables. Utsaah is not responsible for loss, theft or damage to personal items on premises or in lockers.
13) Photography, Video & Marketing
We may capture photos/videos for quality, safety or marketing. Studio-wide visuals may incidentally include participants.

If you prefer not to be identifiable, please inform reception before your session; we will make reasonable efforts to accommodate.

Any personal filming requires prior consent from Utsaah and must not disturb others.

14) Intellectual Property
All content on our website, social media, signage, programs, and materials (names, logos, designs, text, videos) is Utsaah’s intellectual property or used under license. You may not copy, modify, distribute or exploit our content without written permission.
15) Minors & Pregnancy
Minors may participate only with parent/guardian consent, presence if required, and under age-appropriate classes.

Prenatal/postnatal participants must obtain medical clearance and inform instructors prior to class. Certain movements may be modified or restricted for safety.

16) Third-Party Services & Links
We may reference or offer third-party services (e.g., payment gateways, partners). These are governed by their own terms. Utsaah is not liable for third-party acts or omissions.
17) Suspension & Termination
We may suspend or terminate access to Services for violations of these Terms, safety risks, non-payment, misuse, or unlawful conduct. Outstanding dues remain payable.
18) Limitation of Liability
To the fullest extent permitted by law, Utsaah, its owners, directors, employees, and contractors are not liable for indirect, incidental, consequential or punitive damages. Our total liability, if any, shall not exceed the amount you paid for the specific Service giving rise to the claim.
19) Indemnity
You agree to indemnify and hold harmless Utsaah and its team from claims, damages, liabilities, costs and expenses arising from (i) your use of the Services, (ii) breach of these Terms, or (iii) violation of any law or third-party right.
20) Force Majeure
We are not responsible for delays or failures due to events beyond our reasonable control (including but not limited to acts of God, government orders, pandemics, strikes, power failures, or facility issues).
21) Privacy
Your personal information is handled in accordance with our Privacy Policy. By using our Services, you consent to such processing.

22) Changes to Terms & Services
We may update these Terms or modify our Services at any time. Changes take effect upon posting on our website/app. Continued use indicates acceptance of the updated Terms.
23) Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Courts at New Delhi shall have exclusive jurisdiction over disputes, subject to applicable law.
